Progress' software, support, services and related documentation (collectively, the "Product"), are generally exported from Ireland and the U.S. and are subject to U.S., Irish and local country export, import and use laws ("Rules"). The Product will not be used, transferred, exported or re-exported to, or for the benefit of, directly or indirectly, any Government End User, other than those of, or in: a. Austria, Australia, Belgium, Canada, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Japan, Luxemburg, Netherlands, New Zealand, Norway, Poland, Portugal, Slovakia, Spain, Sweden, Switzerland, United Kingdom, United States b. A "Government End User" is defined in U.S. Export Administration Regulations 15 CFR 772 as: c. ny foreign central, regProgressl or local government department, agency, or other entity performing governmental functions; including any governmental research intuitions, governmental corporations or their separate business units which are engaged in the manufacture or distribution of items or services controlled on the Wassenaar Munitions List, and any internatProgressl governmental organizations (UN, NATO, OPEC, etc.). E. The Product will not be used for: a. Designing, developing or fabricating nuclear weapons or nuclear explosive devices, or devising, carrying out, or evaluating nuclear tests or nuclear explosions; b. Designing, assisting in the design of, constructing, fabricating, or operating facilities for the chemical processing of irradiated special nuclear material, for the production of heavy water, for the separation of isotopes of any source and special nuclear material, or specially designed for the fabrication of nuclear reactor fuel containing plutonium; c. Developing, producing or using any military products, weapons, systems or supports; or f. Training personnel in any of the above activities.
